Terms of Service

These terms govern access to and use of MyFNA websites, applications, and related services (together, the "Service"). By creating an account, clicking to accept, or using the Service, you agree to these terms on behalf of yourself and, when applicable, the organization you represent.

Eligibility and accounts

You must have authority to bind your organization if you register on its behalf. You are responsible for activity under your credentials, for maintaining accurate account information, and for who you invite into the workspace. Notify us promptly if you suspect unauthorized access.

What the Service provides

MyFNA provides tools to distribute secure intake questionnaires, collect responses, notify your team, and review or export submissions. Features may change as we ship improvements. We may suspend or limit the Service for abuse, non-payment, security incidents, or as required by law.

Customer obligations

You agree to use the Service only in compliance with law and industry rules that apply to you. You obtain any consents and provide any notices your clients require before collecting their information. You will not upload malware, attempt to break the Service, scrape in bulk without permission, or misuse client data. You remain responsible for advice you give clients; the Service is software, not a recommendation engine for specific financial products.

Fees and taxes

Paid plans are billed through Stripe. You authorize us and Stripe to charge your selected payment method. Fees are non-refundable except where required by law or explicitly stated at checkout. Taxes may be added based on your location and Stripe settings.

Intellectual property

We retain all rights in the Service, branding, and underlying software. You retain rights in your organization data. You grant us a limited license to host, process, and display your content solely to operate and improve the Service for you.

Confidentiality and feedback

We treat non-public information about your workspace as confidential and use it consistent with our privacy policy. If you share feedback or suggestions, we may use that input without restriction or compensation.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IN ANY TWELVE-MONTH PERIOD IS LIMITED TO THE AMOUNTS YOU PAID US FOR THE SERVICE IN THAT PERIOD (OR ONE HUNDRED US DOLLARS IF YOU HAD NO FEES).

Indemnity

You will defend and indemnify us against third-party claims arising from your content, your use of the Service in violation of these terms, or your violation of law.

Termination

You may stop using the Service at any time. We may suspend or terminate access for breach, risk to security, or extended non-payment. Sections that should survive (fees owed, disclaimers, limits, indemnity) survive termination.

Governing law and venue

These terms are governed by the laws of the State of Delaware, excluding conflict-of-law rules. Courts in Delaware have exclusive jurisdiction, except that either party may seek injunctive relief in any court of competent jurisdiction for misuse of intellectual property or abuse of the Service.

Changes

We may modify these terms by posting an updated version with a new effective date. If a change is material, we will provide reasonable notice through the Service or email. Continued use after the effective date constitutes acceptance.
